Help!

I just found out that a Ticket I got in Nyack for going through a red light on my bike shows up on my car driver's license -3 points! I am not sure what to do. Thoughts? it happened two or three years ago,and i happened to find out while i was fighting a speed-trap ticket in the Berkshires (don't get me started). They are piling up,these points! And I don't deserve ;them! what a scam!

please help. the ;bicycle ticket should not be on my license.

Show your passport next time you're detained while on a bicycle?

In all seriousness, I would speak to an attorney who specializes in traffic law.

Unless things have changed, I was told bike infractions do not effect your motor vehicle license. A bike is not a motor vehicle. However, it might effect your good driver rating on your insurance.

I could be wrong.

Fight it

As I understand it and you should not get points on your driver's license. That is not to say that it doesn't happen, but I believe it is correctable.

The logic, as it was explained to me, is that since a driver's licence is not required to operate a bicycle, taking points would result in NYSDMV license holders being more severely penalized than non-holders for the same infraction (ie: fine + points vs. fine only). As long as the 'vehicle' part of your ticket was marked BICYCLE, you ought to be able to get the DMV to reverse the points.

Things may have changed since I last looked into this, but at least that WAS the case; hopefully still is...

Also, if stopped, you are only required to show some form of valid ID to the cop, though they almost always ask to see a license (it makes ticket-writing easier for them). I keep my license buried in my wallet, and show my voter registration card and work photo ID.

call the DMV

As posted elsewhere, as long as the ticket clearly indicates that the violation was comitted on a bicycle, then the NYS DMV will remove the points from your record if you bug them. You'll need to call, write, etc., and be persistent, since this is a mistake they make frequently.

bicycle ticket points fall off after 3 years anyway?

"I fought the speed trap ticket and got it knocked down to ""parking on pavement"". What a scam! But no points.

i have since heard that points fall off your license of their own accord after 3 years in NY. does anyone know if this is so? if it is i will just let the points fall off all by themselves. I will fight to get it taken off if need be but i don't lookforward to fighting with DMV. Also heck if i know where that ticket is now. that was the summer of 2004.

thanks all for your help."

Points are supposed to come off 18 months after the violation.
