CNN Anchor Fined for Leaving Accident

NEW YORK (AP) -- CNN anchor Jack Cafferty will pay a $250 fine and perform 70 hours of community service after pleading guilty to leaving the scene of an accident, prosecutors said Tuesday.

Cafferty had been charged with the traffic infraction, along with misdemeanor charges of reckless driving, assault and harassment, after police said he knocked a man off a bike with his Cadillac on May 14.

""This was never anything more than a traffic incident. It was resolved as a traffic infraction. Jack acted responsibly in this, as he always has,"" said Cafferty's lawyer, Seth Rosenberg.

Cafferty is an anchor on ""American Morning.""

A traffic officer and about five pedestrians ran after Cafferty's car to stop him after the accident, but Cafferty drove through at least two red lights and around other vehicles without stopping, according to a police complaint.

Cafferty was dragging the man's bike underneath his car, police said.

Cafferty later told police that he had seen a man on a bike who may have been a messenger weaving in and out of traffic as Cafferty drove south along Ninth Avenue around 10:25 a.m. When Cafferty looked in his mirror, he saw the man getting up off the ground but was unaware he had hit the bicyclist, the anchor told police.

The bicyclist, Billy Maldonado, told police he was slightly injured.

The unanswered question cyclists want to know is what kind of bike was destroyed."

DETOX

In my legal experience, most drivers flee the scene because they are drunk/high and want to detox for a day before they are caught or turn themselves in.

Nice person Jack. Outstanding !!

share the road, share the blame

Obviously Cafferty's actions were deplorable, and I'd like to see him in court, but was the cyclist riding the wrong way down 9th ave? I recently moved to the city, and I can't believe the absolute ignorance (or the brazen disregard for the law) of the delivery riders, etc who ride against traffic, on the sidewalks etc.

I don't own a car, but I've nearly hit some of these morons while riding, because the last thing I expect to see is another rider coming at me on a busy one-way street. I'm just not programmed for that.

I know these guys have to make a living, and I'm not wishing injuries on them or anything, but...seriously, it's a problem, and it makes every cyclist look bad in the general public's eye.

No doubt this topic has been flogged to death here, but I just had to vent...

Here is CNN's account of the accident.

"July 26, 2003 -- A BICYCLIST who was accidentally struck by a car driven by CNN morning anchor Jack Cafferty claims he was the victim of a hit-and-run.

Billy Maldonado, 48, says he was bicycling on Ninth Avenue near 42nd Street the morning of May 14 when Cafferty hit him.

""There was a red light,"" said Maldonado's lawyer, Suzanne Holzberg. ""[Cafferty's] car pulled up next to Billy [on the bike]. When the light changed [Cafferty] hit Billy and didn't stop.""

Two traffic officers at the scene saw the entire incident and wrote down Cafferty's license plates as he sped away. ""Billy didn't want an ambulance at the time but he ended up going to the hospital,"" Holzberg said.

Cafferty's lawyer, Seth Rosenberg, would say only: ""Jack Cafferty is a very responsible person. He was issued a ticket in connection with a traffic incident. We are confident this matter will be resolved to everyone's satisfaction.""

Maldonado, who is unemployed, took so long to hire a lawyer and investigate the accident because ""he is unsophisticated and didn't know what to do,"" Holzberg said, adding, ""The district attorney's office has been very slow in giving us any information.""

Cafferty's name was only released to Holzberg a week ago, and no address was given for him because, she claims, police told her he was a ""celebrity.""

Maldonado's injuries are ""still under investigation,"" although Holzberg notes that he is currently seeing an orthopedist.

While Assistant DA Dustin Levin looks into the case, Cafferty also faces a possible civil suit. ""We will be suing [Cafferty] in a civil case,"" Holzberg said. ""We will be seeking millions.""

A 20-plus-year veteran of New York nightly news, Cafferty's CNN biography recalls his glory days when he ""distinguished himself as a reporter covering the world's financial capital as well as national news.""

Before joining CNN, Cafferty anchored the ""News at 10"" on the WB-11 from 1992-1998. From 1989-1992, he hosted ""Jack Cafferty's Newsline New York,"" a nightly news and interview program on WNYW-TV, and co-anchored the evening broadcast ""Fox 5 News at 7.""

I wonder...

"If Jack got off so easy because he's a celebrity or because he ONLY used a car to hit a bicyclist?

How could he not notice the bike dragging under his car as he fled the scene? What if there had been a full child seat on the back of the bike?

I usually side with the motorists when the ""anti-car"" lobby gets going, as I feel that most car owners don't want to make contact with us, if for no other reason than they don't want their insurance rates to go up. This makes me question my former position. This guy leaves the scene with a cop in pursuit and does not get a free tour of Rikers Island? I guess the easiest way to get away with murder is to do it with a car."

Cars, weapon of choice for murder

Couldn't agree with you more, including the fact that most motorists who kill or injure cyclists serve no jail time and often pay less in fines than cyclists riding on the sidewalk.

Not just cyclists

Pedestrians, skateboarders, mothers with baby carriages, Starbucks store-fronts filled with coffee drinkers, Califorina farmers' markets, etc.

A Good Defense

"Large, heavy, expensive vehicles not only provide its owner status, it protects them from their actions in several ways. You hit a Cadillac with anything other than an equal behemoth, your vehicle is wrecked -- the Cadillac drives away. In this case, the Cadillac, through its quite ride and soft suspension, lends the reckless driver an excuse: ""I did not know I hit the bicyclist."" Apparently, the Cadillac interior is so well insulated you can't even hear the sound of a bicycling suck under its chassis being dragged around. Had Cafferty been driving a Mini Cooper, this defense would not be very credible."

Hit and Run

I've been involved in two bike/car accidents (me on the bike) in which one left me with a broken hip. BOTH times the drivers KNEW that an accident had occured and BOTH times they left the scene.
Etoain Shrdlu.... these are the people (including Cafferty) who you need to put your Montenegrin curse on!!

A curse on Cafferty

"You are quite right, Stan. However, I hesitate to curse his Cadillac, since that might lead to more traffic injuries and perhaps even to fatalities.

However, I do curse Cafferty's tongue. May it fail him, in increasingly more obvious and embarassing ways, on camera.

I curse his hair, what's left it. May people start writing to him suggesting that he wear a toupe. And when he gets a toupe, may it look like a toupe.

Of course, my Great Uncle Ishtvan, in his day a pretty good racing cyclist and a superb hill climber (essential in a country such as Montenegro) used to say, ""Never criticize another man until you have pedaled 100 kilometers in his bicycle shorts.""

I doubt that Cafferty owns a pair of bicycle shorts. So my final curse is that he awake from a deep sleep to discover he is in Anthony Poole's shorts."
